Introduction

These Terms and Conditions ("Terms") govern your use of the Glass Creative Co. website and our photography services. Glass Creative Co. operates as MG Imageworks, LLC ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

Services

Glass Creative Co. provides professional photography and videography services, including but not limited to:

• Food and restaurant photography
• Commercial event photography
• Videography and video production
• Headshot and portrait photography

Specific services, deliverables, timelines, and pricing are detailed in individual service agreements or contracts with clients.

Booking and Payment

Booking

A booking is confirmed only upon receipt of a signed contract and payment of the required deposit. We reserve the right to decline any booking request.

Deposits and Payment Terms

• A non-refundable deposit (typically 25-50% of the total project cost) is required to reserve your date
• The remaining balance is due according to the terms specified in your service agreement
• Late payments may incur additional fees and delay delivery of final images
• Accepted payment methods: check, credit card, ACH transfer, or other methods as agreed

Cancellation and Rescheduling

• Deposits are non-refundable
• Cancellations made less than 14 days before the scheduled date may result in forfeiture of the full project fee
• Rescheduling requests are subject to availability and may incur additional fees
• We reserve the right to cancel or reschedule due to unforeseen circumstances, illness, or emergencies, in which case we will work with you to find an alternative solution or provide a refund

Copyright and Usage Rights

Photographer's Rights

Glass Creative Co. retains full copyright and ownership of all photographs and videos created during our services. This includes raw files, edited images, and any derivative works.

Website Content and Third-Party Rights

Materials displayed on this website—including images and videos shown in the portfolio, blog, and other public pages—may include work produced under arrangements where copyright, usage rights, or other intellectual property interests are shared with or retained by third parties (for example, clients, brand owners, or prior engagements subject to separate agreements). Nothing in these Terms, and nothing on this website, is intended to assert that Glass Creative Co. holds exclusive copyright in every item displayed where third-party rights may apply. Portfolio and editorial content are provided for illustrative and promotional purposes; rights for any new engagement are governed solely by the written agreement for that project.

Client License

Upon full payment, clients receive a non-exclusive, perpetual license to use the delivered images for:

• Personal or commercial use as specified in the service agreement
• Digital and print marketing materials
• Social media and website use
• Advertising and promotional purposes

Clients may not resell, sublicense, or transfer usage rights to third parties without written permission.

Portfolio and Marketing Use

Unless otherwise agreed in writing, Glass Creative Co. reserves the right to use images from your project for:

• Portfolio display on our website and social media
• Marketing and promotional materials
• Industry publications, contests, and exhibitions

Credit will be given to clients when appropriate. If you require privacy or non-disclosure, this must be specified in your service agreement.

Image Delivery and Editing

• Delivery timelines are specified in your service agreement (typically 2-4 weeks for photography, longer for video)
• Images are delivered via digital download or online gallery
• Standard editing includes color correction, exposure adjustment, and basic retouching
• Additional retouching or specialized editing may incur extra fees
• Raw files are not included unless specifically purchased as an add-on
• We retain images for a minimum of 90 days after delivery; extended archival may incur storage fees

Client Responsibilities

Clients are responsible for:

• Providing accurate project details, timelines, and shot lists
• Ensuring location access and necessary permits
• Coordinating with venue staff or event organizers as needed
• Ensuring food, products, or subjects are prepared and ready for photography
• Communicating any special requirements or restrictions in advance

Limitation of Liability

Glass Creative Co. will make every effort to deliver high-quality services. However, we are not liable for:

• Technical failures, equipment malfunctions, or data loss beyond our control
• Failure to capture specific shots due to circumstances outside our control (e.g., weather, venue restrictions, subject availability)
• Third-party venue restrictions or access limitations
• Errors or delays caused by incorrect information provided by the client

Our total liability for any claim shall not exceed the total amount paid by the client for the specific service in question.

Model and Property Releases

Clients are responsible for obtaining necessary model releases, property releases, and permissions for any individuals, brands, or locations featured in photography or video projects. Glass Creative Co. is not liable for claims arising from lack of proper releases.

Weather and Force Majeure

In the event of severe weather, natural disasters, or other unforeseen circumstances (force majeure), we will work with clients to reschedule or find alternative solutions. No refunds will be issued for delays caused by force majeure.

Disputes and Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or our services shall be resolved through mediation or arbitration in Jacksonville, Florida, before resorting to litigation.

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services constitutes acceptance of revised Terms.
